Roofing Business Operator Receives Probation, Community Service As Part of Sentence

KITCHENER, ONTARIO - An Ontario justice of the peace has sentenced the operator of a Kitchener roofing business to probation and 100 hours of community service for failing to comply with two orders issued by an employment standards officer (ESO).

Neil Alexander Gillis, carrying on business as Golden Triangle Roofing, was ordered by a Ministry of Labour ESO to pay wages and an administration fee relating to claims made by two former employees in October 2013. Gillis pleaded guilty in Kitchener court in September 2015 to two counts of failing to comply with the orders and was convicted on December 15, 2015.

As a result, on November 15, 2016, Justice of the Peace Michael A. Cuthbertson fined Gillis $2,000 for each of the two counts, totaling $4,000 plus a 25-per-cent victim surcharge and ordered him to pay restitution of the remaining amounts of wages owed to the claimants.
In addition, the justice of the peace ordered Gillis to perform 100 hours of community service as part of a two-year probation order. During that two-year period the defendant must not commit the same or similar offence, must appear before the court as and when required and perform the community service to the satisfaction of a community services officer.

The court-imposed 25-per-cent victim fine surcharge is required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.

A person who contravenes the ESA or its regulations, or fails to comply with an order under the act, is guilty of an offence. An individual convicted under the ESA may be fined up to $50,000 or imprisonment of up to 12 months, or both. A corporation can be fined up to $100,000 for a first conviction, $250,000 for a second conviction and $500,000 for a third or more convictions.
